1. The scope of the subscription terms
For agreements with individuals regarding access to Tusass Internet offered by Tusass , the following service-specific terms apply in addition to "General Terms and Conditions for the Delivery and Operation of Tusass A/S Services - Private" and "Service-Specific Terms for the Internet Service - Private ". In contravention of the terms, the Tusass Internet Terms of Service will be subject to the Terms and Conditions.
Definitions :
"Tusass ": Provider
"Tusass Internet ": Product Name
"Automatic Payment": Automatic payments of amounts from the customer's registered payment card, to cover the fixed subscription fee or for not returning the borrowed router.
"Upgrade": Switch to a subscription that has a higher price.
"Downgrading": Switch to a subscription that has the same or lower price.
2. Conditions for becoming a customer
In order to make use of Tusass Internet , the customer must subscribe to the website.tusass.gl.
The customer must be at least 18 years to subscribe .
On the www. tusass.gl customer can register as a customer choose Tusass Internet subscription, set up automatic payment, enter the necessary CPR information, change. Tusass Internet customers must sign up for Automatic Payment.
Tusass 's communication form for Tusass I nternet is digital and is done solely via SMS and / or email. Therefore, the customer must immediately provide Tusass notification of new e-mail and other subscription ts relevant information. It also happens via www.tusass.gl . Tusass may refuse to enter into a subscription agreement, if the customer already has Tusass charges .
3. Prerequisites
3.a. Coverage
It is a prerequisite for the delivery of this subscription agreement that delivery takes place within Tusass 's coverage area for the internet service. Information about Tusass 's coverage area is available at Tusass . If, at the time of the agreement or at a later date, the customer does not have access to the Tusass coverage area, Tusass is not required to provide the service.
3.b. Equipment
Tusass lends the customer a router when establishing Tusass Internet, unless the customer already has a router from Tusass. The router has built-in WI-FI with a code, so the router has a wireless connection. The customer is responsible for precautions regarding the protection of the wireless connection.
When the product is terminated, a return of the router must be made, cf. the deadline as stated in section 7. In case of failure to return within the deadline, an amount of up to DKK 3,000 will be deducted from the customer's payment card to cover Tusass' losses, including postage/shipping costs, administration costs and expenses to cover a new router.
The same applies after Tusass' notice to the customer in a disconnection of Tusass internet due to a breach of terms.
If there is a need for technical support or service on a router, and the customer is not able to return the router to one of Tusass' stores, the customer is required to bear all costs for shipping/postage. In addition, the customer cannot claim compensation for lack of access to the internet for the period when technical support or service on a router is carried out and until the customer has received a new one.
4. Tusass 's delivery obligation
4.a. Facilities and features
It is apparent from Tusass 's product overview for the selected Tusass Internet subscription package , which facilities and features the customer has access to.
The subscription is activated only when the customer takes its Tusass Internet activated.
4.b. Operation and speed
The customer is aware that there may be fluctuations in the communication speed due to Tusass I nternet s technical characteristics.
A connection to Tusass Internet comes with a specified maximum speed. Speed may vary depending on the area in which the customer is located. For all Tusass Internet services , the speeds are stated including a protocol overhead.
Tusass reserves the right to temporarily restrict the use of Tusass Internet in connection with measures deemed necessary for technical, maintenance and safety reasons or which may be required to meet the requirements of the authorities.
Tusass reserves the right to (without the Customer being entitled to claim compensation from Tusass as a result):
To test for open ports (including proxies) as well as open email servers (relays) on the customer's equipment that may give rise to abuse.
To reject incoming and outgoing emails, which are considered to be e.g. virus, spam or phishing.
To block third party connections to Tusass's internet service, where the connection is considered misused, for example. to spread viruses, spam or phishing.
To limit the amount of emails per. unit of time.
To upgrade server software to the required extent
4.c. Customer responsibility for the online ferry
Tusass has no responsibility for what the customer can access online. Consumption on the Internet may result in the client's hardware or software being infected with viruses and / or other malicious software. Tusass has no influence on this and can not be held liable for any damages and / or losses that may arise as a result of this.
5. Payment and malpractice
5.a. Collection
The prices for the services offered under Tusass Internet are determined by Tusass in ht. g aging rules.
5.b. Payment for subscription
Payment for the subscription is made monthly prior to the period and only via payment through www.tusass.gl.
As a rule, Tusass does not send payment receipts for monthly payments. If the customer wishes to receive receipts, it must be activated through login at www.tusass.gl
The customer must be registered for Automatic Payment. When signing up for Automatic Payment, the customer allows Tusass to store the customer's payment card information for debit the customer's debit card when paying a subscription fee to Tusass Internet or for payment of not returning the router.
Automatic Payment acts as a fixed agreement, where the money is deducted from the customer's debit card at the end of each month or as a one-off payment for not returning the router.
If Automatic Payment can not be made due to Customer Relationship, for example, if the payment card is blocked or deleted or there is no cover on the card, notification will be given to the customer's registered email and by SMS. Tusass reserves the right to charge any fee for this.
The customer will be able to view payment history at www.tusass.gl. No bills or usage specifications are provided for services in Tusass Internet .
5. c . Switch between subscriptions
Upgrading:
When the customer upgrades his Tusass Internet subscription, the change will be implemented as soon as possible.
In the case of an upgrade where it is necessary to change the modem, the upgrade only takes effect when the modem has been changed.
Downgrading:
If the customer downgrades his Tusass Internet subscription by the 20th of the month, the downgrade will enter into force at the next month.
If the customer downgrades his Tusass Internet subscription after the 20th of the month, the downgrading will only take effect after the end of the following month.
In the case of a downgrade where it is necessary to change the modem, the downgrade only takes effect when the modem has been changed.
If the customer has made an upgrade, the customer can not subsequently downgrade his Tusass Internet subscription in the same month, as the customer can not downgrade his subscription in the first month after the creation.
5. d . In case of non-payment of subscription fee
Is there coverage for payment of the purchase amount, the Automatic Payment try to implement the payment from the payment card every day the month or until payment has been completed. 6. Abuse
An agreement can only be made for the purchase of one Tusass Internet product per. household where a household is defined on the basis of the population register. Tusass can dispense from here if the technical possibilities allow. Tusass Internet may only be used by the household that has entered into a Tusass agreement. It is not permitted to lend, share, resale, resell or otherwise make Tusass Internet available to third parties.
Misuse causes Tusass Internet to be terminated without notice, cf. 13 H in the General Terms and Conditions for the Delivery and Operation of Tusass A/S 'Services - Private.
In case of suspicion of abuse, for example, if the customer's consumption is estimated to significantly exceed the average customer's average consumption or shows a significant or sudden increase in consumption, compared with previous consumption, Tusass may disconnect or reduce the connection.
The high internet speeds allow for very high data usage. This may mean that some customers use their internet connection so much that other customers experience a lower quality of their connection.
Tusass reserves the right to restrict the subscriber's use of the Service without notice. Restrictions may include:
Reduce the speed of the customer's connection during busy hours (17:00 to midnight on all days)
Reduction of the speed on the subscriber's connection until the next month change
restrictions on the subscriber's use of certain services, including the use of peer-to-peer traffic.
Tusass also reserves the right to discontinue the subscriber's connection to the service or terminate the subscription upon prior notice in case of repeated overruns.
7. Termination
The Customer may terminate the Tusass Internet Subscription , with a notice by no later than 20th of a month for the termination to come into force the following month.
A Tusass internet subscription is valid until: Subscription terminated . Or, if your payment exceeds 1 month.
When the customer chooses to terminate the subscription agreement, the customer will per SMS and e-mail get notification from Tusass that the customer must return the borrowed modem within 30 days after the end of the subscription agreement. The customer receives SMS and e-mails 25 days before, 5 days before and 1 day before the modem is to be delivered.
8. Right of withdrawal
You are entitled to withdraw from the subscription in accordance with the rules set out in the Consumer Contracts Act. You can cancel the subscription by calling Tusass or sending Tusass an e-mail no later than 14 days after receiving the order confirmation.
If you reside in a location that requires the dispatch of equipment used for the services before the expiry of the withdrawal period, and you have been informed of the right of withdrawal and of the prices applicable to the subscription, you will be charged an amount corresponding to the proportionate time that the service has been in use before the withdrawal. In case of cancellation, the equipment provided must be returned at your expense by regular mail, and you are asked to keep the receipt for the postal shipment until you have received confirmation that Tusass has received the equipment.
9. Entry into force
This service-specific terms for Tusass Internet enters into force 1. november 2022.
