Scope of subscription terms
For agreements on access to the Internet service for businesses offered by Tusass under the company's concession, the following service-specific terms apply in addition to General subscription terms for the delivery and operation of Tusass's services. In the event of a conflict between the terms, the service-specific subscription terms precede.
Prerequisites
It is a prerequisite for the delivery of this subscription agreement that delivery takes place within Tusass's coverage area for the internet service. Information on Tusass's coverage can be obtained from Tusass. If the customer at the time of the agreement, or at a later date, does not have access to Tusass's coverage area, Tusass is not obliged to provide the service.
Tusass's delivery obligation, including mailbox
It appears from Tusass's product brochure for the chosen subscription form whether the customer has access to Internet facilities at Tusass.
Operation and speed
Tusass is entitled to make necessary changes to the Internet service, including among other things: user names, password, IP addresses and other codes assigned by Tusass in connection with the subscription, if Tusass deems it necessary for technical, maintenance and operational reasons. Tusass is also entitled to make changes that may be necessary to meet the requirements of the authorities. Tusass reserves the right to reduce the speed of the internet product in connection with the use of streaming services. The customer's possible expenses in connection with changes are Tusass irrelevant, and no claims for damages can be made against Tusass in this regard.
The technical characteristics of the Internet service and the special nature of the Internet mean that fluctuations in the communication speed can occur via the Internet service. For all Tusass's Internet services, the speeds are stated including protocol overhead.
Tusass reserves the right to temporarily limit the possibilities of using the Internet service due to operational and security issues.
Tusass also reserves the right (without the customer requiring compensation from Tusass, as a result):
To test for open ports (including proxies) and open email servers (relays) on the customer's equipment that may give rise to abuse.
To reject incoming and outgoing e-mails that are considered to be eg. virus, spam or phishing.
To block third party connections to Tusass's Internet service, where the connection is deemed abused, eg. to spread viruses, spam or phishing.
To limit the amount of e-mails per unit of time.
To upgrade server software as necessary.
Dynamic IP-adress
1. General information about Dynamic IP address
When purchasing home workplace internet, you receive an internet connection that uses a dynamic IP address. A dynamic IP address is automatically assigned by our systems and may change periodically without prior notice. This means that your Internet connection will not have a fixed IP address, but an address that can vary over time.
2. Use and Obligations
By using a dynamic IP address, you agree that your IP address may change without notice and that it is your responsibility to ensure that any network configurations or services that depend on a static IP address are adjusted accordingly.
3. Disclaimer
Tusass A/S is not responsible for any problems that may arise because of changes in your dynamic IP address. This includes, but is not limited to, loss of access to external servers, VPN connections, remote access or other services that require a fixed IP address.
4. Security and Privacy
With home workplace internet, your IP address will change regularly, which can make it more difficult for outside actors to target your network activities. However, you should still follow the usual security measures, including using strong passwords, VPN services, and up-to-date security protocols.
5. Upgrade to Static IP address
Should you need a fixed, static IP address, you can contact Tusass Erhverv to request an upgrade. This service is offered upon request and may be subject to additional costs and specific terms.
6. Changes in the Service
We reserve the right to change or update the dynamic IP services as needed to ensure optimal performance and security. Any changes will be implemented without significantly affecting your Internet connection, and we will endeavor to notify you if major changes occur.
7. Restrictions on Use
Certain services or applications that require constant access via a specific IP address may be incompatible with a dynamic IP address. It is your responsibility to ensure that these services function properly with a dynamic IP. Tusass A/S does not assume responsibility for any limitations or interruptions in the use of such services.
Email address
It appears from Tusass's product fact sheet for the chosen form of subscription to Internet access, whether the customer is entitled to electronic mailboxes with one or more email addresses. Any e-mail addresses belong to Tusass and are only made available to the customer until the subscription agreement ends.
The customer is responsible for ensuring that any e-mail addresses do not infringe on the rights of third parties. The customer must not exceed the storage capacity specified in the product specification sheet and any limits on the amount of traffic transferred etc.. for e-mails.
Subscription agreement
Tusass may refuse to enter into a subscription agreement, if the customer already has arrears to Tusass in connection with the offering of services covered by the Tusass's license.
At Tusass's request, the customer must be able to identify and document the accuracy of the information. Image ID may be required. Upon change of address, the customer must immediately notify Tusass of this.
Customer's responsibility
Subscription number, user name, password, any IP addresses and other codes for use in connection with the subscription are provided by Tusass. Subscription number, password etc. may not be disclosed to third parties except for any registered user. The Customer bears responsibility for the misuse of this information by others.
Subscription number, user name, password, IP addresses and other codes made available by Tusass are Tusass's property and are considered returned at the end of the subscription.
It is the customer who is responsible for what information he uses on the Internet. This includes all information available on the Internet.
The customer may, when using and downloading material from the Internet or by opening programs in the received email, risk infecting his computer with virus or at the customer's general movement on the Internet be exposed to external influences. Tusass has no influence on these matters and cannot be held liable for damages and losses as a result.
The customer is responsible for all information that the customer makes available to others via the Internet service, and the customer must keep Tusass harmless in all circumstances in this respect. The customer is also responsible for securing copyrights using material from the Internet.
If the customer uses the Internet for trading or acquisition of network services, Tusass is without responsibility, as this is only a balancing act between the customer and third parties.
In connection with the delivery of the Internet service, the customer must supply electricity and store Tusass's equipment in a safe manner. The customer must also bear any expenses in this regard.
Customer's default (Tusass's closed). In the event of the Customer's material breach of obligations arising from the use of the Internet service offered by Tusass under the Company's concession, Tusass is entitled to discontinue Customer's access to the Internet service. The following factors are considered, inter alia, for material breach:
The customer scans other computers on the Internet or seeks to gain unauthorized access to hacking systems.
The customer's connection is abused with or without the customer's knowledge for example. spread of virus, spam, phishing etc.
The customer violates third parties' copyrights by download, distribution or the like.
The customer deletes or falsifies transmission information, including ip addresses or header information.
The customer repeatedly violates the current unwritten rules for good practice on the Internet.
Discontinuing access to the Internet service does not result in a refusal of the subscription fee for the period in question.
When the customer's connection according to the above is interrupted, Tusass can terminate the subscription agreement without notice.
The non-compliance provisions in Tusass's general terms and conditions also apply.
Entry into force
These terms and conditions have been approved by Naalakkersuisut and will enter into force on 01.09.2010. However, for customers who have entered into an agreement for the delivery and operation of Tusass's services before 1 September 2010, the terms and conditions shall not apply until 01.12.2010.
In addition, the following product-specific conditions apply to Flatrate Internet Business:
1. Flatrate Internet, Business may only be used by the company that has entered into an agreement with Tusass A/S. It is not permitted to lend, share, resell, resell or in any other way make the Flatrate Internet Business available to third parties. Abuse means that Flatrate Internet, Business is interrupted without notice, cf. 12 H in the General Terms and Conditions for the Delivery and Operation of Tusass A/S 'Services, Business, and that the abuse is reported to the authorities for the purpose of prosecution.
2. To the extent that these product-specific terms are in violation of the General Terms and Conditions for the Delivery and Operation of Tusass A/S 'Services, Business or the applicable Service-Specific Terms of the Internet Service, Business, these product-specific terms shall prevail.
